You're assuming they collected anything from that lawsuit. The article states the subcontractor filed for bankruptcy protection after trying to countersue Boeing.

Either way, Boeing missing the deadline due to a sub missing the deadline due to COVID-19 is COVID-19 delaying the project. Under normal circumstances once might tell a contractor to pound sand on an extension request, but this might be justified given how disruptive the pandemic has been.
